3. Placing an Order
Orders may be placed through our online configurators, by email or by phone. Each order will be confirmed by us in writing before production begins.
A binding contract is formed only when:
- you have approved your production proof in writing;
- full payment has been received; and
- we have confirmed the order has entered production.
We reserve the right to refuse any order at our reasonable discretion, including where requested designs are unlawful, infringe third-party rights, or are outside our reasonable production capability.
4. Pricing & Payment
Prices are displayed in GBP and are inclusive of UK VAT where applicable. International orders may incur additional duties, taxes and import fees, which are the responsibility of the customer.
Shipping is charged separately and quoted at checkout or with your order confirmation.
Full payment is required before production begins. We accept major debit and credit cards via secure payment providers (such as Square).
We reserve the right to amend prices at any time. Once an order is confirmed and paid, the agreed price is locked in.
5. Bespoke & Custom-Made Goods: No Cancellation Right
The majority of our products are bespoke, custom-made or personalised to your specifications. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you do not have a right to cancel an order for goods that are made to your specifications or clearly personalised.
This means that once your design has been approved and production has begun, you cannot cancel the order or return the product for a refund unless the product is faulty (see clause 8).
6. Production & Delivery
Estimated production lead times are provided at the point of order. Typical lead times are 20-30 working days from the point the order is submitted to production, plus shipping. Express production is available on selected products for an additional fee, please ask for details.
Lead times are estimates only and may vary due to manufacturing capacity, material availability, supplier delays, or other factors outside our reasonable control. We will keep you informed of any material delays.
Delivery dates are not guaranteed. Risk in the goods passes to you upon delivery to the address you have provided.
7. Design, Logos & Intellectual Property
If you supply us with logos, sponsor artwork, photographs or other designs to incorporate into your product, you warrant that you have the necessary rights or permissions to use those designs. You agree to indemnify us against any third-party claim arising from your use or supply of such designs.
We retain ownership of original design work created by our in-house design team as part of a bespoke design service. You receive a licence to use the resulting product but not the underlying design files unless separately agreed.
The Custom Racewear brand, logo and website content are protected by copyright and trade mark rights and may not be reproduced without our written consent.
8. Faulty Goods & Statutory Rights
Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2015. Products must be of satisfactory quality, fit for purpose and as described.
If your product is faulty or not as described, please contact us within a reasonable time of discovering the issue at info@customracewear.co.uk with your order details and photographs. Where the fault is confirmed, we will at our reasonable discretion repair, replace or refund the product at no cost to you.
See our Returns Policy for the full process.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability to you in respect of any order shall not exceed the total amount paid by you for that order.
We do not exclude or limit liability for:
- death or personal injury caused by our negligence
- fraud or fraudulent misrepresentation
- any liability which cannot be excluded under English law
10. Force Majeure
We are not liable for any failure or delay in performance caused by events outside our reasonable control, including (without limitation) acts of God, industrial action, war, civil unrest, pandemic, supplier failure, or shipping carrier disruption.
11. Governing Law
These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms or your order will be subject to the exclusive jurisdiction of the courts of England and Wales.
